January 7, 2005 - Wage & Hour Class Action Complaint filed against Wackenhut Corporation in Los Angeles Superior Court by Plaintiff Nivida Lubin on behalf of all Security Officers employed by Wackenhut Corporation in California (the Lubin case)

March 22, 2005 - First Amended Complaint against Wackenhut Corporation filed in the Lubin case by Plaintiff Lubin

June 7, 2005 - Plaintiff took the deposition of Wackenhut's Vice-President for the Western Region

June 21, 2005 - Plaintiff took the deposition of Wackenhut's Human Resources Administrator

May 3, 2006 - Wage & Hour Class Action Complaint filed against The Wackenhut Corporation and Oracle Corporation in San Mateo County Superior Court by Plaintiffs Morgan Fay, Jr. and Joseph Oertwig on behalf of The Wackenhut Corporation Security Officers at the Oracle facility in Redwood City, California (the Fay case) 

July 3, 2006 - Wage & Hour Class Action Complaint-in-Intervention filed against The Wackenhut Corporation and Wackenhut Services, Inc. in the Lubin case by Plaintiffs-in-Intervention John Lightner, Sylvia Maresca and SEIU Local 24/7 on behalf of all Security Officers employed by The Wackenhut Corporation in California 

January 4, 2007 - First Amended Complaint-in-Intervention filed against The Wackenhut Corporation in the Lubin case by Plaintiffs-in-Intervention Lightner and Maresca

March 9, 2007 - Second Amended Complaint-in-Intervention filed against The Wackenhut Corporation in the Lubin case by Plaintiffs-in-Intervention John Lightner, Sylvia Maresca, Craig Franklin, and Lucio Agard

June 27, 2007 - Wage & Hour Class Action Complaint filed against Wackenhut Services, Inc. and The Wackenhut Corporation in Los Angeles Superior Court by Plaintiff Sylvia Maresca on behalf of all Security Officers employed by Wackenhut Services, Inc. and The Wackenhut Corporation in California (the Maresca case)

July 18, 2007 - Motion for Class Certification granted in the Fay case

October 30, 2007 - Petition for Transfer and Coordination of the Fay case with the Lubin and Maresca cases filed by The Wackenhut Corporation and Oracle Corporation

January 31, 2008 - Court denied the Petition to transfer and coordinate the Fay case with the Lubin and Maresca cases

February 19, 2008 - First Amended Complaint against Wackenhut Services, Inc. and The Wackenhut Corporation filed in the Maresca case by Plaintiff Maresca

February 26, 2008 - Plaintiffs in the Lubin case began taking the deposition of Wackenhut's Controller for Shared Services (Deposition to be continued)

February 27, 2008 - Plaintiffs in the Lubin case began taking the deposition of Wackenhut's employee that was designated as the most qualified to testify on Wackenhut's behalf with regard to various matters (Deposition to be continued)

March 14, 2008 - Wage & Hour Class Action Complaint filed against The Wackenhut Corporation in Orange County Superior Court by Plaintiff Kevin Denton on behalf of all Security Officers employed by The Wackenhut Corporation in California (the Denton case) 

May 23, 2008 - Lubin and Maresca cases stayed by the Court pending a decision on The Wackenhut Corporation's Petition to Transfer and Coordinate the Denton case with the Lubin and Maresca cases 

May 27, 2008 - Petition for Transfer and Coordination of the Denton case with the Lubin and Maresca cases filed by The Wackenhut Corporation

June 19, 2008 - After more than two years of litigation, the Plaintiffs in the Fay case reached a Tentative Settlement Agreement with Wackenhut that covers a Class of all non-supervisory Wackenhut Security Officers who worked at the Oracle facility located in Redwood City, California between May 3, 2002 through May 31, 2007

September 16, 2008 - Court granted the Petition to transfer and coordinate the Denton case with the Lubin and Maresca cases; The three cases became the Wackenhut Wage and Hour Cases, Judicial Council Coordination Proceeding No. 4545 

September 29, 2008 - Court extended the stay of proceedings in the Lubin and Maresca cases

November 5, 2008 - Coordination Trial Judge assigned to the Wackenhut Wage and Hour Cases

November 24, 2008 - Coordination Trial Judge entered an order scheduling the Wackenhut Wage and Hour Cases for a Further Status Conference on January 16, 2009

January 16, 2009 - The attorneys for Plaintiff Nivida Lubin, the attorney for Plaintiffs Sylvia M. Maresca and Lucio Agard, and the attorney for Plaintiff Kevin Denton, as well as several attorneys for Defendant The Wackenhut Corporation and the attorney for Defendant Wackenhut Services, Inc., appeared before the court for a Further Status Conference and the Court lifted its order staying proceedings 

January 16, 2009 - The parties informed the Court that they have agreed on a schedule for the motion for class certification in the Lubin and Denton cases; The Plaintiffs will file their Motion for Class Certification by April 27, 2009; Wackenhut will file its Opposition to the Plaintiffs' motion for class certification by May 27, 2009; the Plaintiffs will then file a Reply to Wackenhut's Opposition to the motion for class certification by June 17, 2009

February 17, 2009 - The Plaintiffs in the Lubin and Denton cases took the deposition of Wackenhut's Vice-President for the California Region 

February 17, 2009 - After nearly three years of litigation, the Class of Plaintiffs in the Fay case obtained the Court's final approval of their June 2008 class action settlement agreement with Wackenhut; Congratulations!

March 11, 2009 - The deposition of Wackenhut's General Manager for the Los Angeles and San Fernando Valley Branch Offices was cancelled because of a scheduling conflict

March 12, 2009 - The Court granted the request by Plaintiffs in the Lubin and Denton matters to set a new hearing date for the motion for class certification in their case because the discovery process is going slower than expected; the Plaintiffs in the Lubin and Denton matters will now file their joint Motion for Class Certification by June 26, 2009; Wackenhut will file its Opposition to the Plaintiffs' motion for class certification by July 24, 2009; the Plaintiffs will then file a Reply to Wackenhut's Opposition to the motion for class certification by August 17, 2009; the Court will hear oral arguments on the motion for class certification on September 1, 2009

April 1, 2009 - The Court heard oral arguments on the Plaintiffs-in-Intervention's Motion to Compel Wackenhut to Produce Documents Responsive to Discovery propounded in the Lubin matter; The Court also heard oral arguments on Wackenhut's Motion to Compel Global Protective Orders for the Wackenhut Wage & Hour Cases

May 21, 2009 - The Court granted the request by Plaintiffs in the Lubin and Denton matters to set a new hearing date for the motion for class certification in their case because the discovery process is going slower than anticipated; the Plaintiffs in the Lubin and Denton matters will now file their joint Motion for Class Certification by September 28, 2009; Wackenhut will file its Opposition to the Plaintiffs' motion for class certification by October 30, 2009; the Plaintiffs will then file a Reply to Wackenhut's Opposition to the motion for class certification by November 20, 2009; the Court will hear oral arguments on the motion for class certification on December 2, 2009

June 24, 2009 - The Court entered an order to protect the confidentiality of information, documents, and other materials and things exchanged between the parties during the discovery process in the Wackenhut Wage and Hour Cases

August 7, 2009 - The Plaintiffs in the Lubin and Denton cases took the deposition of Wackenhut's General Manager for the San Diego branch office

August 13, 2009 - The Plaintiffs in the Lubin and Denton cases took the deposition of Wackenhut's General Manager for the San Francisco and San Jose branch offices 

August 20, 2009 - The Plaintiffs in the Lubin and Denton cases took the deposition of Wackenhut's Senior Vice-President of Human Resources

September 8, 2009 - The Plaintiffs in the Lubin and Denton cases filed their Coordinated Complaint against The Wackenhut Corporation; the Coordinated Complaint alleges that Wackenhut did not authorize and permit the non-exempt Security Officers/Guards it has employed in California since January 7, 2001 to take paid duty-free rest breaks of at least 10 minutes for every four hours worked during a shift; the Coordinated Complaint also alleges that Wackenhut has a policy of not providing off-duty meal periods to non-exempt Security Officers/Guards in California who work more than five hours in a shift; for these alleged meal and rest break violations, the Plaintiffs ask the Court to order Wackenhut to pay additional wages and statutory penalties to the members of the proposed Plaintiff Class

September 28, 2009 - The Plaintiffs in the Lubin and Denton cases filed their Motion for Class Certification Against The Wackenhut Corporation (Not Wackenhut Services, Inc.)

October 8, 2009 - Wackenhut filed a Motion asking the Court to keep under seal (i.e., not accessible to the public) the documents filed in support of Plaintiffs' Motion for Class Certification, including, without limitation, over 100 declarations of current and former Security Officers/Guards who are members of the proposed Plaintiff Class

October 15, 2009 - Wackenhut filed a Motion asking the Court to stay (i.e., delay) the proceedings in the Wackenhut Wage & Hour Cases

October 23, 2009 - The Court granted the Ex Parte Application by Wackenhut's lawyers for additional time to file Wackenhut's Opposition to Plaintiffs' Motion for Class Certification; Wackenhut's Opposition to the Plaintiffs' Motion for Class Certification is now due on November 23, 2009 and the hearing on the Motion for Class Certification is now scheduled for December 22, 2009

October 26, 2009 - Wackenhut took the deposition of Plaintiffs' expert

November 4, 2009 - The Plaintiffs in the Lubin and Denton cases filed an opposition to Wackenhut's motion to stay the proceedings in the Wackenhut Wage & Hour Cases

November 9, 2009 - Wackenhut took the deposition of six (6) individuals who are members of the proposed Plaintiff Class; two (2) individuals were deposed in Los Angeles and four (4) individuals were deposed in San Francisco

November 10, 2009 - Wackenhut took the deposition of three (2) individuals who are members of the proposed Plaintiff Class; one (1) individual was deposed in San Francisco and one (1) individual was deposed in Sacramento

November 11, 2009 - Wackenhut took the deposition of three (3) individuals who are members of the proposed Plaintiff Class in Los Angeles

November 11, 2009 - Wackenhut filed a Reply to Plaintiffs' opposition to Wackenhut's request to stay the proceedings in the Wackenhut Wage & Hour Cases

November 12, 2009 - Wackenhut took the deposition of two (2) individuals who are members of the proposed Plaintiff Class in Los Angeles

November 16, 2009 - Wackenhut took the deposition of two (2) individuals who are members of the proposed Plaintiff Class in Los Angeles

November 17, 2009 - Wackenhut took the deposition of three (3) individuals who are members of the proposed Plaintiff Class in Los Angeles

November 18, 2009 - Wackenhut took the deposition of two (2) individuals who are members of the proposed Plaintiff Class in Sacramento

November 19, 2009 - The Court denied Wackenhut's Motion to Stay the proceedings in the Wackenhut Wage & Hour Cases

November 19, 2009 - The Court granted the second Ex Parte Application by Wackenhut's lawyers for additional time to file Wackenhut's Opposition to Plaintiffs' Motion for Class Certification; Wackenhut's Opposition to the Plaintiffs' Motion for Class Certification is now due on November 30, 2009; the hearing on the Motion for Class Certification will go forward on December 22, 2009

November 24, 2009 - The Court granted the Ex Parte Application by Wackenhut's lawyers for permission to extend the page limit for Wackenhut's Opposition to Plaintiffs' Motion for Class Certification

November 30, 2009 - Wackenhut filed its 35-page Opposition to the Plaintiffs' Motion for Class Certification

December 17, 2009 - The Plaintiffs in the Lubin and Denton cases filed their Reply Brief in Support of the Motion for Class Certification Against The Wackenhut Corporation

December 22, 2009 - The Court conducted a hearing on the Plaintiffs' Motion for Class Certification

December 29, 2009 - The Court entered an Order to stay the proceedings in this lawsuit pending a decision by the Court on the Plaintiffs' Motion for Class Certification 

March 3, 2010 - The Court entered an Order Granting Class Certification

March 15, 2010 - The Court denied Wackenhut's Ex Parte Application for a stay of the proceedings in the Wackenhut Wage & Hour Cases

March 23, 2010 - The Court granted Wackenhut's renewed request for a temporary stay of the proceedings

April 12, 2010 - Wackenhut filed with the Court of Appeal a Petition for Writ of Mandate or Other Appropriate Writ Reversing Order Certifying Class

May 6, 2010 - The Court lifted the temporary stay it had entered on March 23, 2010

May 17, 2010 - The Court of Appeal granted Wackenhut's Emergency Application for Temporary Stay of Trial Court Proceedings Pending Decision on Writ Petition
